The step-by-step plan for claiming your compensation
The personal injury process can vary depending on the situation, but generally it involves the following four steps.
Step 1. Registration with Hardt Advocaten
- Report your injury via our online contact form or contact us by phone. We only ask for basic information such as your name and phone number. One of our personal injury specialists will contact you on the same business day to discuss the accident and your injuries.
- During an initial (intake) consultation, our personal injury lawyer will discuss the accident, your complaints, and the damages you suffered with you. Based on this consultation, we will assess whether your claim is feasible.
- You will then receive a clear explanation of our working methods and sign forms authorizing us to act on your behalf in the case.
Step 2. Determining liability
- Once you authorize us, your personal injury expert will formally hold the liable party liable. We will submit all relevant information to you.
- If liability is acknowledged, we can request an advance payment on your compensation on your behalf, so you don't have to wait for the final settlement of the case. This advance often covers some of your direct costs, such as medical bills.
- In cases where liability is not immediately acknowledged, we will conduct negotiations on your behalf or, if necessary, initiate legal proceedings.
Step 3. Calculation of your compensation
- The other party's insurer will contact Hardt Advocaten to discuss your case. We will ensure that all necessary information is collected to calculate your total damages. This includes:
- Material damage such as medical expenses, loss of income, home adjustments or loss of earning capacity.
- Non-pecuniary damages, also known as pain and suffering, to compensate for emotional distress, pain and diminished enjoyment of life.
- In consultation with you, we will request medical information from your healthcare providers to substantiate the extent of your damages with medical advice. All evidence will be carefully collected and submitted.
4. Negotiations and settlement of your case
- Once all damages have been identified, your personal injury lawyer will submit a full settlement proposal to the other party's insurer. This proposal will specify an amount for the full compensation, including compensation for pain and suffering.
- Negotiations can sometimes take some time, depending on the complexity of the case and the other party's willingness to settle. During this phase, Hardt Advocaten will maintain close contact with you and keep you updated on progress.
- It's important to know that processing a claim can take months, or even years. This is because a claim can only be definitively settled once you have fully recovered from your injury or your medical conditions remain stable.
- After successful negotiations, you will receive full compensation. You will also sign a settlement agreement confirming that you will not file any further claims for the same incident.
- We ensure that you receive a tax guarantee, so you do not have to pay tax on the compensation received.
